These Terms & Conditions govern the use of the Canary Billiards website and the purchase of products through canarybilliards.com.
By placing an order through our website, you agree to these Terms & Conditions.
These terms are intended to comply with applicable Spanish and European consumer protection and e-commerce legislation. Nothing in these terms limits any mandatory rights you have as a consumer under applicable law.

Canary Billiards sells billiards and pool equipment, accessories and related products online, primarily serving customers in the Canary Islands.
2. Using our website
You may use this website for lawful purposes only.
You must not use the website:
- In a way that violates applicable law;
- To attempt to gain unauthorised access to our systems;
- To interfere with the operation or security of the website;
- To submit false or misleading information; or
- To use automated systems to scrape, copy or abuse the website without our permission.
We reserve the right to restrict access where reasonably necessary to protect the website, our business or other users.
3. Product information
We make reasonable efforts to ensure that product descriptions, photographs, specifications and prices are accurate and up to date.
However:
- Product photographs may vary slightly from the actual product, particularly because of differences in screens and lighting.
- Manufacturers may occasionally change product specifications, packaging or appearance.
- Where a product is supplied in different packaging from that shown in a photograph, this does not necessarily mean that the product itself is different.
Where a product has specific characteristics that are important to its use, these will be stated in the product description wherever reasonably possible.
Nothing in this section limits your statutory rights if a product does not conform to the contract.
4. Prices
All prices displayed on the website are the prices applicable to the products at the time of purchase.
Any applicable taxes and mandatory charges will be shown during the purchasing process.
Delivery charges are not included in the product price unless expressly stated. Applicable delivery charges will be displayed before you place your order.
Where a price or product description contains an obvious error, we reserve the right to correct the error. If an order has already been placed based on an obvious pricing or description error, we will contact you before processing the order and give you the option to proceed at the correct price or cancel the order.
5. Orders
You can place an order by following the purchasing process on our website.
Before submitting your order, you will be shown the products in your basket, quantities, prices, applicable delivery charges and the total amount payable.
You are responsible for checking that the information in your order is correct before submitting it.
When does a contract exist?
When you click the final order button and complete the checkout process, you are making an offer to purchase the products in your order.
We will send you an acknowledgement of your order by email.
The sales contract is formed when we accept your order, normally when we confirm the order and begin processing it.
If we cannot accept your order — for example because a product is unavailable or there has been an obvious pricing error — we will inform you and refund any payment already made.
Spanish consumer legislation requires online customers to be clearly informed, immediately before ordering, that placing the order creates an obligation to pay.
6. Product availability
We aim to keep the products shown as available on the website in stock.
Most of our products are held locally in the Canary Islands and are normally available for dispatch without waiting for an international shipment.
However, stock levels can occasionally change before an order is processed.
If a product becomes unavailable after you place an order, we will contact you as soon as reasonably possible and offer an appropriate solution, which may include a refund.
If we cannot fulfil an order because the product is unavailable, you will be entitled to recover any amount you have paid for that product. Spanish law provides specific protections where an online order cannot be fulfilled.
7. Custom orders and quotations
We can source certain products that are not currently listed on our website, including billiards tables and other specialist equipment.
Custom orders or special purchases may require a quotation.
A quotation will specify the product, price, delivery arrangements and any other relevant conditions.
A quotation is not an order until it has been accepted and payment arrangements have been agreed.
Where a product is made specifically to a customer’s specifications or is clearly personalised, the statutory right of withdrawal may not apply where the legal requirements for that exception are met.
Any applicable exception will be explained to you before you commit to the purchase.
8. Payment
We currently offer payment methods including:
- Credit and debit cards (processed securely by WooPayments, powered by Stripe)
- Apple Pay
- Google Pay
Payment must be completed using one of the payment methods offered during checkout.
Card payment details are processed by the relevant payment provider. Canary Billiards does not store your complete card number or card security code.
9. Delivery
We deliver within the Canary Islands using Correos Express (booked through the Packlink shipping platform). You can also collect your order free of charge from Los Realejos. See our Shipping page for current options and prices.
Available delivery options, costs and estimated delivery times will be shown during checkout.
We will normally dispatch stocked products as soon as reasonably possible, and our aim is to dispatch most stocked orders on the next working day.
Delivery times are estimates rather than guaranteed deadlines unless we have expressly agreed a specific delivery date.
If there is a significant delay or we are unable to fulfil an order within the applicable legal period, you will have the rights provided by applicable consumer legislation.
Under Spanish consumer law, unless otherwise agreed, an online order should generally be executed without undue delay and no later than 30 calendar days after the contract is concluded.
Our current delivery options and prices are shown on our Shipping page and are always displayed at checkout before you pay.
10. Risk and delivery
For consumer purchases, Canary Billiards remains responsible for the goods until you, or a third party designated by you other than the carrier, physically receives them, unless applicable law provides otherwise.
If an order is lost or damaged during delivery, please contact us as soon as possible so that we can investigate the matter with the carrier.
This does not affect your statutory consumer rights.
11. Right of withdrawal
If you are a consumer purchasing products online, you generally have the right to cancel your purchase within 14 calendar days without giving a reason.
For goods, the 14-day period normally begins on the day you, or a third party designated by you other than the carrier, receives the goods. Where an order contains multiple goods delivered separately, the period generally begins when the last goods are received.

You can simply send us a clear statement explaining that you wish to cancel your purchase, including your order number and the products concerned.
You may also use the standard withdrawal form included at the end of these Terms, although you are not required to use that form.
The important thing is that you clearly communicate your decision to withdraw before the 14-day period expires.
Returning the goods
After informing us that you wish to withdraw, you must return the goods without undue delay and, in any event, within 14 calendar days of communicating your decision.
Unless we have agreed to pay the return costs, you are responsible for the direct cost of returning the goods.
Goods should be returned securely packaged and in a condition that allows us to determine their nature, characteristics and functioning.
You may handle the goods as reasonably necessary to establish their nature, characteristics and functioning, but you may be responsible for any reduction in value resulting from handling beyond what is reasonably necessary.
Refunds
When you validly exercise your right of withdrawal, we will refund the payments we have received from you, including the standard delivery cost originally charged.
If you selected a more expensive delivery option than the least expensive standard delivery option we offer, we are not required to refund the additional amount.
We will normally make the refund using the same payment method used for the original transaction, unless you expressly agree otherwise.
We may withhold the refund until we have received the returned goods or you have provided evidence that you have sent them back, whichever occurs first.
Spanish law provides for reimbursement without undue delay and generally within 14 days after notification of withdrawal, subject to the statutory rules concerning receipt of the goods or proof of return.
12. Exceptions to the right of withdrawal
The statutory right of withdrawal does not apply to certain products and circumstances established by law.
This can include, for example:
- Products made to the customer’s specifications or clearly personalised;
- Products that, by their nature, cannot be returned;
- Certain sealed products that are unsuitable for return for health or hygiene reasons once unsealed; and
- Other statutory exceptions applicable to particular products or services.
Where an exception applies to a product you are purchasing, we will provide the required information before you place your order.
The statutory exceptions are set out in Spanish consumer legislation.
13. Faulty or non-conforming products
Your statutory legal guarantee applies separately from the 14-day right of withdrawal.
For new goods sold to consumers in Spain, the statutory period of responsibility for lack of conformity is generally three years from delivery.
If a product is defective or does not conform to the contract, please contact us at:

- A description of the problem; and
- Photographs or other information that may help us assess the issue, where appropriate.
Depending on the circumstances and applicable law, you may be entitled to have the product brought into conformity through repair or replacement, and where those remedies are unavailable or inappropriate, to a price reduction or termination of the contract and refund as provided by law.
The legal guarantee cannot be excluded or reduced by these Terms & Conditions.
14. Damage caused by misuse or normal wear
The legal guarantee does not make us responsible for damage caused by:
- Incorrect use;
- Accidents;
- Improper installation or maintenance;
- Failure to follow manufacturer instructions;
- Modifications or repairs carried out without authorisation; or
- Normal wear and tear that does not constitute a lack of conformity.
This does not affect any statutory rights you may have where the problem nevertheless constitutes a legal lack of conformity.
15. Complaints
If you have a problem with an order, product or service, please contact us first:
We aim to resolve complaints fairly and promptly.
Please include your order number and a description of the issue so that we can investigate it.
16. Intellectual property
Unless otherwise stated, the content of the Canary Billiards website, including text, photographs, graphics, logos, designs and other materials, belongs to Canary Billiards or is used with permission.
You may not reproduce, distribute, modify or commercially exploit our content without our prior written permission, except where permitted by law.
Product names, logos and trademarks belonging to third-party manufacturers remain the property of their respective owners.
17. Website availability
We aim to keep the website available and functioning correctly, but we cannot guarantee uninterrupted access.
The website may occasionally be unavailable because of maintenance, technical problems, security issues or circumstances outside our reasonable control.
This does not affect your statutory rights as a consumer.

19. Applicable law and jurisdiction
These Terms & Conditions are governed by Spanish law, subject to any mandatory consumer-protection rights that apply to you under applicable EU or national legislation.
If you are a consumer resident in the European Union, nothing in these Terms removes any mandatory rights or protections available to you under the law applicable to your consumer contract.
Where a dispute cannot be resolved directly with us, you may use the consumer dispute-resolution mechanisms available under applicable law.
20. Changes to these Terms
We may update these Terms & Conditions from time to time to reflect changes to our business, website, products or legal requirements.
The version applicable to your purchase will be the version in force at the time you place your order.
The latest version will always be published on this page.
